UrbexNow terms and conditions

For digital maps, locations and upgrades.

These terms apply in addition to the information on the product page, the delivery policy, refund policy and privacy statement. In the event of a conflict with mandatory consumer law, the law prevails.

Article 1

Definitions

UrbexNow
the trade name under which Global Adventure Factory offers digital products;
Customer
any natural person or legal entity entering into a contract with UrbexNow;
Consumer
a natural person acting for purposes outside their trade, business, craft or profession;
Digital content
data produced and supplied in digital form, including maps, coordinates, location data, files, links and upgrades;
Product page
the page describing the digital product, price, content, method of delivery and any technical requirements;
Contract
the contract between UrbexNow and the customer concerning the supply of a product;
In writing
communication by letter, email or another durable electronic form.

Article 3

Scope and availability

  1. These terms apply to every offer, order and contract of UrbexNow.
  2. The terms are made available electronically before the contract is concluded, so the customer can read and save them.
  3. Deviations are valid only when expressly agreed in writing.
  4. If a provision is void, voidable or unenforceable, the remaining provisions continue to apply. Where possible, the parties replace it with a valid provision that most closely reflects its purpose.
  5. For consumers, mandatory consumer law always prevails where these terms deviate from it.
Article 4

Offer and product information

  1. UrbexNow describes on the product page the main characteristics of the product, the price, method and time of delivery and, where relevant, technical or account requirements.
  2. Images, quantities and examples are intended to explain the product. Obvious writing, pricing or system errors do not bind UrbexNow.
  3. For a map, the number of locations may change due to updates, clean-up, duplicate locations, removed locations or changed data. The description at the time of purchase determines what was agreed, unless expressly stated otherwise.
  4. UrbexNow does not sell a mandatory subscription. A map, individual location or upgrade is purchased as a separate digital product, unless a future offer expressly and clearly states otherwise.
  5. Important purchase information may not appear only in these terms where the law requires it to be clearly shown on the product page or in checkout.
Article 5

Formation of the contract and payment

  1. The contract is formed when the customer places the order, the payment instruction is processed successfully and UrbexNow confirms the order.
  2. Before payment, the customer checks the selected products, email address and any account details.
  3. Prices shown during checkout include applicable taxes unless expressly stated otherwise.
  4. Only payment methods offered in the Shopify checkout may be used for the order.
  5. UrbexNow may refuse or further review an order in the event of an obvious error, suspected fraud, misuse, unauthorised resale or incomplete payment. Any amount already received will be refunded if no contract is formed.
Article 6

Digital delivery and access

  1. The digital content is supplied in the manner and within the period stated on the product page, during the ordering process or in the order confirmation.
  2. Digital delivery takes place through the UrbexNow account or another digital method explicitly stated with the product.
  3. When an UrbexNow account is required for digital access, the customer uses the correct account details for the order.
  4. Digital content is considered made available as soon as the customer can actually open it through the agreed digital channel.
  5. After ordering, the customer checks the inbox, spam folder and provided account details.
  6. Further delivery rules are set out in the delivery policy.
Article 7

Right of withdrawal and immediate digital delivery

  1. A consumer generally has a fourteen-day cooling-off period for a distance contract, unless a statutory exception applies.
  2. For digital content not supplied on a tangible medium, the right of withdrawal expires only when all statutory conditions are met, including prior express consent to delivery during the cooling-off period, acknowledgement of the loss of the right of withdrawal and the required confirmation thereof.
  3. If these conditions are not met, UrbexNow cannot conclude solely on the basis of these terms and conditions that the withdrawal period has expired.
  4. A consumer may communicate a valid withdrawal by means of an unequivocal statement, by email, through the legally required online withdrawal function or by using the model form.
  5. The right of withdrawal is separate from rights relating to digital content that was not delivered or is defective.
  6. The practical rules are set out in the refund policy.
Article 8

Conformity, defects and updates

  1. Upon delivery, the digital content must conform to the contract and possess the characteristics that the customer may reasonably expect on the basis of the offer.
  2. If access does not work or the product differs materially from the contract, the customer must report this as soon as possible and provide sufficient information for an investigation.
  3. UrbexNow will attempt to remedy a defect within a reasonable period and free of charge, for example by restoring access, correcting data, providing a working link or offering an appropriate replacement delivery.
  4. If remedy is impossible or disproportionate, is not completed within a reasonable period, the defect recurs or the defect is sufficiently serious, statutory rights to a price reduction or termination may arise.
  5. Updates are included only to the extent agreed on the product page, in the order confirmation or under mandatory law.
Article 9

Changing nature of urbex locations

  1. After information has been collected, urbex locations may be closed, demolished, renovated, secured, repurposed or otherwise changed.
  2. UrbexNow does not guarantee that a location will still exist at a later date, be freely accessible or remain in the same condition.
  3. A later change does not automatically entitle the customer to a refund where the changing nature was clearly stated in advance and the digital content conformed to the contract upon delivery.
  4. This article does not exclude statutory rights where the content was materially incorrect, unusable or otherwise not as agreed upon delivery.
  5. Reports about changed locations may be submitted through the designated update page.
Article 10

Licence to use and intellectual property

  1. After valid payment, the customer receives a limited, personal, non-exclusive and non-transferable licence to use the purchased digital content.
  2. All intellectual property rights in the compilation, structure, texts, maps, design, database and other content remain with UrbexNow or the relevant rights holder.
  3. Without prior written permission, it is not permitted to:
    • share digital content, links, files or access with third parties;
    • resell or publicly distribute products in whole or in part;
    • use the content to build a competing map, database, website, channel or service;
    • circumvent security measures or access restrictions;
    • automatically retrieve, copy or scrape large quantities of data.
  4. A purchase does not transfer ownership of the underlying data, map or database to the customer.
Article 11

Responsible, safe and lawful use

  1. Purchasing digital location information does not grant permission to enter a building, site or other location.
  2. The customer is responsible for checking ownership, permission, local regulations, current conditions and safety.
  3. The customer must not force entry, damage anything, take anything or leave waste behind.
  4. The customer must not use the information for theft, vandalism, intimidation, dangerous conduct or other unlawful activities.
  5. UrbexNow does not encourage trespassing, unlawful entry or risky behaviour.
Article 12

Suspension, blocking and termination

  1. UrbexNow may temporarily suspend or block access where there are reasonable indications of:
    • unauthorised sharing, copying or resale;
    • fraud, misuse or manipulation of an order;
    • a serious or repeated breach of these terms;
    • a security risk to UrbexNow, other customers or an external service.
  2. Where reasonable, the customer will be given an opportunity to provide an explanation or end a remediable breach.
  3. In the event of a serious or irremediable breach, UrbexNow may terminate the personal licence.
  4. Suspension or termination must not restrict statutory consumer rights and must be proportionate to the nature of the breach.
  5. A customer is not entitled to compensation to the extent that termination is the direct result of demonstrably serious misuse, unless mandatory law provides otherwise.
Article 13

Liability

  1. UrbexNow is liable for loss to the extent that it is the direct and attributable result of a failure to perform and liability may not be excluded by law.
  2. UrbexNow is not responsible for loss arising because the customer:
    • enters a location without permission;
    • ignores warnings, regulations or safety risks;
    • provides incorrect contact or account information;
    • uses the digital content contrary to these terms.
  3. For consumers, the statutory rules on liability and conformity apply. Nothing in these terms limits liability for intent, deliberate recklessness, death or personal injury to the extent that exclusion is not permitted.
  4. For business customers, UrbexNow’s liability is limited, to the extent permitted by law, to the amount paid for the relevant order. Liability to business customers for indirect loss, consequential loss, loss of profit and loss of savings is excluded, except in the event of intent or deliberate recklessness by UrbexNow’s management.
Article 14

Force majeure and external services

  1. UrbexNow is not liable for delay or non-performance resulting from circumstances beyond its reasonable control, such as disruptions affecting hosting, payment providers, email services, mapping services, internet connections or government measures.
  2. During force majeure, the relevant obligations are suspended. UrbexNow will attempt to limit the consequences and resume delivery.
  3. If the force majeure lasts for an unreasonably long time and delivery can no longer take place, the parties may terminate the unperformed contract. Any amount already paid for a part that remains undelivered will be refunded.
Article 15

Complaints, support and evidence

  1. A complaint may be submitted through the contact form or by email to info@urbexnow.com.
  2. For an order enquiry, the customer must state the order number, the email address used, the product title and a clear description of the problem.
  3. UrbexNow will respond within a reasonable period and may request additional information necessary to investigate the complaint.
  4. The parties will first attempt to resolve a dispute between themselves.
Article 16

Personal data

UrbexNow processes personal data for orders, digital delivery, support, security and other stated purposes. More information is available in the privacy policy.

Article 17

Amendments to the terms

  1. UrbexNow may amend these terms when legislation, services, systems used or business processes change.
  2. In principle, the version in force when the contract was concluded continues to apply to that contract.
  3. An amendment may not retroactively restrict existing consumer rights.

Article 18

Applicable law and disputes

  1. The contract is governed by Dutch law.
  2. A consumer residing in another EU or EEA Member State retains the protection of the mandatory consumer rules of the country in which they habitually reside, to the extent that such protection applies under the applicable law.
  3. Disputes may be submitted to the court having jurisdiction under the law. These terms do not require a consumer to bring proceedings exclusively before the court of UrbexNow’s place of establishment.

For digital content, the right of withdrawal may expire under the conditions laid down by law. A defect, non-delivery or other lack of conformity is governed by rules other than the ordinary withdrawal period.
